Why Can’t I Use My Sister’s Divorce Attorney?

I want to use the very nice Attorney that my sister used for her divorce. Sure. First, let me ask you this. Would you go to a Chinese restaurant for a good steak dinner? How about taking your spouse or your girlfriend to McDonald’s for a romantic dinner? Well if you want this to be your last romantic dinner with your girlfriend/spouse, that’s a good idea. But, unfortunately the law is broken into categories and specialties. You wouldn’t go to a plumber for a roof repair, and you wouldn’t go to a dentist for a stomach ache. Do you really believe that a family lawyer has the background and experience to adequately represent you in a Personal Injury case? The truth is that most Personal Injury Attorneys are unskilled in handling Personal Injury cases, apart from “negotiations.” They just don’t have the capacity or the firepower to go into court and adequately practice in the Personal Injury arena. If you don’t believe that you and I will start a divorce practice. Unfortunately, I’ll have to bail and you will have to carry the ball because I don’t want to lose my license. And that’s a fact. But if you feel confident with a divorce lawyer, then go for it.

My philosophy for the last 37 years is to master one area of law and to bet the best. And that is what we practice, today and tomorrow. We’re talking most specifically litigation. But if your case has minimal value and requires only negotiation, then you could actually use your grandmother, she’ll be happy to get new dentures in return for settling your case. If you believe you can receive a fair settlement without a Trial lawyer involved, experienced in litigation for a Personal Injury case, then I’ll hire that person. Thirty years ago, I worked for an Insurance Defense law firm for over ten years. Bottom line, the odds are stacked against you, in favor of the Defense law firm. If your lawyer is not willing to appear in court on your behalf, then believe him. He’s telling you the truth and he knows that he’s a lightweight. He doesn’t want battle scars that a judge can expect to give you when he sees your weakness. Listen to your lawyer. Go out and find a Trial lawyer.
