Why Can’t I Use My Own Doctor?

I had an accident. Why can’t I use my own doctor that I’ve been using for years? The answer to that is: What is your goal? Is there an insurance company involved that’s going to pay the bills? Or is it just an insurance plan that you don’t necessarily have to deal with? You just go to the doctor and your bill is Medicare? Well if you’re dealing with an insurance company and are expecting them to pay the bills down the line, ask your doctor, the one you’ve had for years, is he comfortable with going to a deposition? He knows what that is. He’ll likely tell you no, not at all. As a matter of fact, most doctors that treat patients, are not comfortable going to court or handling a deposition. Especially if it’s a disputed claim. A reason is that doctors are trained to treat patients, not to wind up in court in a deposition. And they are uncomfortable with that whole process. What about you? Are you looking forward to being involved in litigation? That means your deposition being taken and being grilled by at least one or two attorneys for two or three hours. Of course you’re not. And your doctor is most likely the same mind set. He’s not comfortable being called to testify before a judge or a jury for that matter.

When you have an attorney, your attorney is hopefully one who goes to court on cases against insurance companies. They have their own doctors that are going to look at you and testify against your injuries and against giving you any compensation for those injuries. So question is, are you serious about your claim? If you’re serious then listen to what your attorney says and go along with him as he selects the best doctor for you to use who is familiar with this whole process and is used to court proceedings and those that involve deposition.

Your attorney should make it really easy for you. The litigation process is quite simple; it is not too complicated. If your attorney is used to handling cases in litigation, as we are here at Nelson & Natale, then he’ll be able to quiet your nerves and make the situation more comfortable for you as you proceed on with your case. Believe me, litigation is the only answer should insurance companies balk at giving you what is fair and what is reasonable under the circumstances for the injuries that you have suffered.

Choose a trial attorney. They will go into a case with one foot on a banana peel. Turn your case over to someone who has the experience and the knowhow to handle your case. Remember, you can only be a winner by choosing a winner. That’s why winners choose Nelson & Natale.
